Bill McDonald and Dave Pierangeli recently prevailed in an insurance coverage dispute resulting in an award of damages, costs and interest in excess of $1,000,000.00 payable to a WMM client. The case involved an out-of-state motor vehicle accident resulting in serious injuries to a former Michigan resident who had moved to Florida. Her carrier initially rejected her claim and refused to pay her medical bills which exceeded $600,000.00. WMM initiated a suit for declaratory relief, culminating with the entry of a judgment in favor of our client.

Charles H. Worsfold recently tried and won a double fatality ATV case in Berrien County. He successfully defended United Fixtures Company upon whose land the tragic accident occurred. Two young ladies were killed when their ATV struck a cable between two posts while traveling at a high rate of speed. The plaintiffs' attorney asked the jury for $3 million dollars in damages for each death.

Dave Pierangeli successfully argued the case of Neal v. Wilkes, before the Michigan Supreme Court in which the Court pronounced a new standard for the application of the Recreational Land Use Act. Dave also prevailed in the Court of Appeals on issues involving the proof required by a dependent to establish paternity when seeking no-fault benefits as well as application of the statue of limitations in UCC cases.

Jim Lohr prevailed in the Court of Appeals on a matter involving insurance coverage. The Court of Appeals decision led to a large settlement on behalf of the client who sustained severe injuries in a slip and fall accident.
